These Terms of Service apply to your access to and use of Pingtree websites, applications, and related services.
By accessing or using the services, you acknowledge and agree to these terms. If you do not agree, you should not access or use the platform.
Additional terms may apply to specific features, products, or services. Where additional terms conflict, those additional terms control for that feature.
Eligibility and account responsibilities
You must be at least 18 years old to use the services. If you use the platform on behalf of a business, you represent that you are authorized to bind that entity.
You are responsible for maintaining accurate account details, protecting credentials, and notifying Pingtree of unauthorized account access.
Electronic communications
By creating an account, you consent to receive electronic and telephonic communications such as account notices, payment notices, and transactional updates.
Electronic notices satisfy legal communication requirements where written notice is required.
Prohibited activities
You may not use the platform in a way that violates law, infringes rights, harms other users, or interferes with service operation.
- Impersonating a person, entity, or brand without authorization
- Using another user's account without permission
- Scraping, data mining, reverse engineering, or bypassing access controls
- Harassing, threatening, or abusive conduct
- Using the service for illegal or unauthorized purposes
Disclaimers and limitation of liability
Services are provided on an 'as is' and 'as available' basis without warranties, to the maximum extent permitted by law.
Pingtree is not liable for indirect, incidental, special, or consequential damages. Aggregate liability is limited to amounts paid by you for the services, subject to applicable law.
Dispute resolution
Most disputes are resolved through confidential binding arbitration in San Diego, California under JAMS rules, except where small claims or injunctive relief applies.
Class and representative actions are waived. Claims must generally be brought within one year after they arise.
Governing law, changes, and termination
These terms are governed by California law, without regard to conflict-of-law principles.
Pingtree may update these terms from time to time. Continued use after updates constitutes acceptance.
Accounts are generally monthly unless otherwise contracted, and may be terminated according to these terms.
