This comprehensive Acceptable Use Policy (AUP) integrates your specific platform requirements with the mandatory 2026 advertising standards for Meta, Google, and TikTok, as well as federal (FTC/FCC) and Florida state (FDBR) regulations.
This Acceptable Use Policy ("AUP") is a material part of your agreement with Pingtree, LLC ("Pingtree"). Your use of the Pingtree platform, API, and associated services is strictly conditioned upon your compliance with these standards. Violation of this AUP may lead to immediate account suspension or permanent termination without refund.
1. Zero-Tolerance Prohibited Activities
You are strictly prohibited from using the Pingtree platform for:
- Deceptive Marketing: Any activity that constitutes "Bait-and-Switch" marketing or unsubstantiated performance claims.
- Illegal Robocalls/Robotexts: Sending automated communications without documented, prior express written consent that meets the 2026 "One-to-One" specificity standards.
- Sensitive Data Collection: Collecting Social Security numbers, precise geolocation, or biometric data without explicit, documented consent as required by the Florida Digital Bill of Rights (FDBR).
- System Abuse: Attempting to bypass Pingtree's rate-limiting, wallet-billing triggers, or third-party API security measures.
2. Multi-Platform Advertising Compliance
All content generated, managed, or distributed through Pingtree must comply with the 2026 standards of our integrated partners:
- Meta (Facebook/Instagram): You must not use "negative framing" or assert personal attributes (e.g., medical or financial status) in ad creatives.
- Google Ads: All landing pages must be mobile-optimized and meet "Technical Quality" standards, including fast load times and functional navigational elements.
- TikTok: Commercial content must be disclosed using TikTok's "Branded Content" tools, and you must not use AI-generated synthetic performers to represent human testimonials without a "Produced by AI" label.
3. AI Transparency and FTC Compliance
Pursuant to the 2026 FTC Disclosure Guidelines for AI-generated content:
- Mandatory Labeling: Any marketing creative (image, video, or text) substantially produced or modified by AI must feature a clear and conspicuous label (e.g., "AI-Generated Content").
- Disclosure Proximity: AI disclosures must be placed immediately adjacent to the claim or creative, ensuring they are not buried in dense text or behind "Read More" buttons.
- No Synthetic Deception: You may not use AI to create endorsements from real individuals without their verified legal consent.
4. Enforcement: Warnings and Termination
Pingtree utilizes automated signal monitoring to detect high-risk behavior that threatens our platform's reputation with major ad networks.
Tiered Warning System
Warning Letter: Issued for minor technical non-compliance (e.g., broken links). You have 24 hours to remediate before feature suspension.
Compliance Suspension: Access to specific marketing channels (e.g., SMS or Meta integration) is paused immediately for legal non-compliance until proof of remediation is provided.
Automatic Termination (No Notice): Pingtree will permanently terminate your account, revoke access to all data, and forfeit all remaining Wallet balances for the following "Critical Breaches":
- Platform De-listing: Any action that causes Pingtree's master API or partner status with Meta, Google, or TikTok to be restricted.
- Consent Fraud: Forging or misrepresenting TCPA/FDBR consent records or using "pre-ticked" opt-in boxes.
- Carrier Blocking: Triggering massive carrier-level blocking due to spam or high-volume violations of "Quiet Hours" (8:00 AM - 9:00 PM local time).
- Verified Malice: Using the platform for phishing, malware, or targeted harassment.
5. Florida State Enforcement
As a Florida entity, Pingtree reserves the right to report systemic violations of data privacy or deceptive marketing directly to the Florida Department of Legal Affairs for enforcement under the Florida Digital Bill of Rights.
